TERMS AND CONDITIONS
Effective Date: August 20, 2026
These Terms and Conditions (“Terms”) govern access to and use of the website, mobile properties, physical club locations, pop-up events, private events, and all related services (collectively, the “Services”) offered by House of Bam Social Club, LLC, a Georgia limited liability company with a
principal address at 2360 Drew Valley Rd NE, Brookhaven, GA 30319 (“House of Bam,” “we,” “us,” or “our”). References to “House of Bam,” “the Club,” or “the Social Club” refer to House of Bam Social Club, LLC and, where the context requires, its physical premises and hosted events.
BY ACCESSING THE SITE, PURCHASING A MEMBERSHIP, REGISTERING FOR AN EVENT, PURCHASING RETAIL GOODS, OR OTHERWISE USING THE SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICES.
1. Definitions
- “User” means any individual who accesses the Site, browses or purchases retail goods, registers for an Event, or otherwise interacts with the Services, whether or not that individual holds a membership.
- “Member” means a User who has enrolled in and maintains an active House of Bam membership (Founding or Standard, as described in Section 3). Provisions of these Terms that reference “Members” specifically — including membership dues, renewal, cancellation, and Club rules — apply only to Members, while provisions referencing “Users” apply to all individuals interacting with the Services, including Members.
- “Site” means the House of Bam website and any associated mobile or web applications.
- “Event” means any workshop, tournament, social gathering, retreat, pop-up, or private event hosted, co-hosted, or facilitated by House of Bam, whether at a House of Bam location or an off-site or third-party venue.
- “Club” or “premises” means House of Bam’s permanent physical location, any pop-up location, and any off-site venue used to host an Event.
- “Content” means, without limitation, all text, graphics, logos, photographs, video, designs, and other materials made available through the Services, including the House of Bam name, the House Flower mark, and related branding.
2. Eligibility
The Service is not intended for individuals under the age of 18.
House of Bam does not knowingly collect any Personal Identifiable Information from children under the age of 13. If we learn at any time that we have been providing services to or have collected the information of a child under the age of 13 then we will immediately destroy this personal information unless we are legally obligated to retain such data. Please email us at [PRIVACY EMAIL] if you believe that we have unintentionally provided services to or collected the information of a child under the age of 13.
We encourage parents and guardians to observe, participate in, and/or monitor and guide their online activity. If you think that your child provided this kind of information on our website, we strongly encourage you to contact us immediately and we will do our best to promptly remove such
information from our records. Children between the ages of 13 and 18 years of age must receive permission from a parent of legal
guardian to access this website.
You must be at least 18 years old to create an account, register for an Event, make a retail purchase, or apply for membership. Where an Event or area of the Club involves the service of alcohol, House of Bam reserves the right to require that all attendees in that area be at least 21 years old and to request valid government-issued identification before serving alcohol or admitting an individual to that area. House of Bam reserves the right to refuse service, registration, or membership to any individual who does not meet applicable age requirements.
3. Membership
3.1 Membership Tiers
All references to currency are to United States Dollars (USD). House of Bam currently offers the following annual membership tiers for Members (subject to change for new enrollments as described below):
- Founding Member: $1,000.00 per year. The Founding Member rate is guaranteed and will not increase for the first two (2) years of continuous membership from the Member’s original enrollment date, after which House of Bam may adjust the rate for subsequent renewal terms upon notice as described in Section 3.3.
- Standard Member: $2,000.00 per year.
House of Bam reserves the right to introduce, modify, or retire membership tiers, benefits, and pricing for new enrollments at any time. Any such change will not alter the locked-in rate applicable to a current Founding Member during that Member’s applicable rate-lock period.
3.2 Enrollment and Payment
Membership begins upon House of Bam’s acceptance of a completed application and receipt of the applicable annual dues. Membership is personal to the individual Member, is non-transferable, and may not be shared, sold, sublicensed, or used by any other individual.
3.3 Auto-Renewal
Membership dues automatically renew annually on the anniversary of the Member’s enrollment date, using the payment method on file, unless the Member cancels auto-renewal at least ten (10) days before the renewal date as described in Section 3.4. House of Bam will provide reasonable advance notice before processing a renewal charge or before any change to a Member’s renewal rate takes effect. You can avoid automatic renewal by notifying the House of Ban of you decsion not to renew by sending an email to: admin@houseofbam.com.
3.4 Cancellation; No Refunds
Membership dues are non-refundable. A Member may cancel auto-renewal at any time by notifying House of Bam at the contact address in Section 22, effective for the next renewal cycle. Cancellation does not entitle a Member to a refund, in whole or in part, of dues already paid for the
current membership term, and the Member’s access to Member benefits continues through the end of the then-current paid term.
3.5 Club Rules and Code of Conduct
Members and their guests are expected to conduct themselves in a manner consistent with the House of Bam community standards at all times while on the premises or attending an Event, including, without limitation:
• Treating staff, other Members, guests, and event partners with courtesy and respect;
• Complying with any posted house rules, capacity limits, dress expectations, and game-table etiquette;
• Complying with all applicable laws, including those governing alcohol consumption and gambling, at all times on the premises;
• Respecting the privacy and property of other Members and guests; and
• Following any guest policy communicated by House of Bam regarding the number and conduct of guests a Member may bring to the Club or an Event.
House of Bam reserves the right, in its sole discretion, to suspend or terminate a Member’s membership, without refund, for conduct that violates these Terms, applicable law, or House of Bam’s community standards, or that House of Bam reasonably determines is harmful to other Members, guests, staff, or the reputation of House of Bam.
4. Event Registration
4.1 Registration and Payment
Events, including workshops, tournaments, retreats, pop-ups, and private events, may require advance registration and payment through the Site or another House of Bam-approved payment channel. Event capacity, pricing, and inclusions are as described in the applicable Event listing at the time of registration.
4.2 Cancellation and Refund Policy
A User who cancels an Event registration at least seven (7) days prior to the scheduled Event date will receive a full refund of the registration fee paid. No refunds will be issued for cancellations made less than seven (7) days before the Event, or for no-shows, regardless of the reason for cancellation or non-attendance.
4.3 Changes or Cancellation by House of Bam
House of Bam reserves the right to reschedule, modify, or cancel an Event due to, without limitation, insufficient enrollment, venue or vendor issues, weather, or other circumstances beyond its reasonable control. If House of Bam cancels an Event outright, registered Users will receive a full refund of the registration fee or, at House of Bam’s discretion, credit toward a future Event.
5. Retail Purchases
5.1 Products and Availability
House of Bam may offer branded merchandise, game accessories, and related retail goods for sale through the Site or at the Club. Product descriptions, images, and availability are subject to change without notice, and House of Bam does not warrant that product descriptions or other Content are accurate, complete, or error-free.
5.2 Pricing and Payment
All prices are listed in U.S. dollars and are due at the time of purchase. House of Bam reserves the right to correct pricing errors and to cancel and refund any order affected by such an error.
5.3 Returns and Exchanges
Unused, unopened retail items in original condition may be returned or exchanged within fourteen (14) days of the purchase date with proof of purchase, for a refund to the original payment method. Items that are used, damaged, or missing original packaging, and any items marked as final sale, are not eligible for return. House of Bam reserves the right to deny a return that does not meet these conditions.
6. Photography, Video, and Media Consent
By entering a House of Bam location, attending an Event (including off-site or private Events), or otherwise participating in the Services, you consent to being photographed, filmed, and recorded, and you grant House of Bam a worldwide, royalty-free, perpetual right to use your image, likeness, and
voice as captured in such photographs, video, or recordings, in whole or in part, for marketing, promotional, editorial, and social media purposes, in any medium now known or later developed, without further notice or compensation. This consent applies to all Users and Members and does not
require a separately signed release except where House of Bam requests one for a specific production. If you do not wish your image or likeness to be used, you may notify House of Bam in writing by sending an email to admin@houseofbam.com, and House of Bam will use commercially reasonable efforts to exclude you from future marketing materials. This does not require House of Bam to recall, edit, or remove materials already produced, published, or distributed.
7. Assumption of Risk; Liability Waiver and Release
7.1 General Premises and Activity Risk
Participation in House of Bam activities, including game play, social gatherings, workshops, retreats, and other Events, whether at a permanent House of Bam location, a pop-up, or an off-site venue, carries inherent risks, including but not limited to slips, falls, minor injuries, and incidents arising from the conduct of other attendees. By entering the premises or participating in an Event, you voluntarily assume all such risks.
7.2 Alcohol
House of Bam holds its own license to sell and serve alcoholic beverages at its permanent location and, where applicable, at Events, and House of Bam staff are the licensed sellers and servers of any alcohol provided on the premises. As a condition of purchasing, being served, or consuming alcohol at a House of Bam location or Event, you agree to: (a) present valid government-issued identification confirming you are at least 21 years old upon request; (b) drink responsibly and in accordance with applicable law; and (c) comply with the reasonable direction of House of Bam staff regarding alcohol service. House of Bam reserves the right, in its sole discretion, to refuse or discontinue alcohol service to any individual, including any individual who appears intoxicated or who cannot produce valid identification. You assume all risks associated with the consumption of alcohol at a House of Bam location or Event.
7.3 Personal Property
House of Bam is not responsible for the loss, theft, or damage of personal property brought onto the premises or to an Event, whether or not the property is left unattended.
7.4 Off-Site and Private Events
For Events held at a venue not owned or operated by House of Bam. House of Bam is not responsible for the condition of the venue, acts or omissions of third-party venue staff, or risks specific to that location, and the terms of the third-party venue (if any) apply in addition to these Terms.
7.5 Release and Waiver
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU RELEASE, WAIVE, AND DISCHARGE HOUSE OF BAM, ITS MEMBERS, MANAGERS, EMPLOYEES,
CONTRACTORS, AND AFFILIATED VENUE AND VENDOR PARTNERS FROM ANY AND ALL CLAIMS, LIABILITIES, OR DAMAGES ARISING OUT OF OR RELATED TO YOUR
PRESENCE AT THE CLUB OR PARTICIPATION IN AN EVENT, EXCEPT TO THE EXTENT CAUSED BY HOUSE OF BAM’S GROSS NEGLIGENCE OR WILLFUL MISCONDUCT. This release survives the end of your membership or attendance at an Event.
8. Intellectual Property
8.1 House of Bam Content
The Site, the House of Bam name, the House Flower mark, and all related logos, designs, photography, and other Content are the property of House of Bam Social Club, LLC or its licensors and are protected by trademark, copyright, and other intellectual property laws. Except as expressly
permitted by these Terms, you may not copy, reproduce, distribute, modify, or create derivative works from any House of Bam Content without prior written consent.
8.2 User-Generated Content License
If you post, tag, or submit content referencing House of Bam (including social media posts, reviews, and event photos) (“User Content”), you retain ownership of that content, but you grant House of Bam a non-exclusive, royalty-free, worldwide, sublicensable license to use, reproduce, adapt, and
display that User Content for marketing, promotional, and editorial purposes in any medium. You represent that you have the right to grant this license and that your User Content does not infringe any third party’s rights.
8.3 Limited License to Use the Site
Subject to your compliance with these Terms, House of Bam grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial use.
9. Social Gaming; No Gambling
House of Bam is a private social club that offers board games, card games, tabletop and party games, tournaments, and related social programming for entertainment purposes only.
HOUSE OF BAM IS NOT A CASINO AND IS NOT A GAMBLING ESTABLISHMENT. HOUSE OF BAM DOES NOT OFFER, OPERATE, HOST, SPONSOR, OR FACILITATE GAMBLING, WAGERING, BETTING, OR ANY GAME PLAYED FOR MONEY OR ANYTHING ELSE OF VALUE.
Membership dues, Event registration fees, and retail purchases are payment for access to the Club, its programming, and its goods. They are not wagers, stakes, buy-ins, or entries into any game of chance, and they do not entitle any User to a cash prize, payout, or return of any kind. House of Bam does not bank, host, or take a rake, percentage, or other cut of any game, and does not hold, transmit, or settle player funds. Where an Event or tournament awards a prize, the prize is awarded on the basis of skill or participation and consists of non-cash items such as merchandise, Club credit, or recognition.
While on the premises or at an Event, you may not: (a) make, accept, place, record, or settle any bet or wager; (b) play any game with cards, dice, or balls for money or any other thing of value; (c) operate or participate in any lottery, betting pool, raffle, or similar scheme, except a charitable raffle
conducted in compliance with applicable law and with House of Bam’s prior written consent; or (d) bring, install, or use any gambling device on the premises. Gambling is a misdemeanor under Georgia law (O.C.G.A. § 16-12-21), and Georgia does not recognize a private-club or social-game exception.
House of Bam enforces this policy strictly. Any User who violates this Section may be removed from the premises or an Event immediately, and any Member who violates this Section may have their membership suspended or terminated without refund under Section 3.5. House of Bam may report suspected unlawful gambling activity to law enforcement.
10. Privacy
In connection with your use of the Services, House of Bam may collect certain information from you, including contact information, payment information, and information about your use of the Site. House of Bam will handle that information in accordance with its posted Privacy Policy, which is incorporated into these Terms by reference. You consent to House of Bam’s collection, use, storage, and processing of your information as described in the Privacy Policy, including storage and processing in any jurisdiction in which House of Bam or its service providers operate.
11. Prohibited Conduct
You agree not to do any of the following while using the Services:
- Republishing, redistributing, or commercially exploiting any Content in any other medium without House of Bam’s prior written consent;
- Selling, transferring, sublicensing, or otherwise monetizing your access to the Site or your membership;
- Damaging, disabling, overburdening, or impairing the Site, or interfering with any other user’s access to or use of the Services;
- Using the Services in violation of any applicable law or regulation of the State of Georgia or any other applicable jurisdiction;
- Using the Services to distribute unsolicited advertising or marketing materials; or
- Scraping, harvesting, or otherwise extracting data or information from the Site by automated or manual means.
House of Bam may investigate any suspected violation of this Section and may suspend or terminate
your access to the Services under Section 20.
12. Account Security and Data Loss
If you create an account on the Site, any user ID and password associated with that account are confidential, and you are responsible for safeguarding them and for all activity occurring under your account. You agree to notify House of Bam promptly of any unauthorized use of your account. House of Bam does not guarantee the security of your account or of any content you submit, and you use the Services at your own risk. House of Bam is not responsible for the loss, corruption, or deletion of any content or data you submit through the Services.
13. Third-Party Links and Advertising
The Site may display advertisements for, or links to, third-party websites, products, or services (“Third-Party Content”), including those of venue partners, vendors, and event sponsors. House of Bam does not control and is not responsible for the availability, accuracy, or content of any Third-
Party Content, and the inclusion of Third-Party Content does not imply endorsement. Your dealings with any third party are solely between you and that third party.
14. Disclaimers; Limitation of Liability
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. TO THE FULLEST EXTENT PERMITTED BY LAW, HOUSE OF BAM’S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT
EXCEED THE AMOUNT YOU PAID TO HOUSE OF BAM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. HOUSE OF BAM WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
15. Indemnification and Defense
You agree to indemnify, defend, and hold harmless House of Bam Social Club, LLC and its members, managers, employees, and contractors from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms, your misuse of the Services,
or your conduct at the Club or an Event.
16. Dispute Resolution; Binding Arbitration
You and House of Bam agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding arbitration administered under the rules of a recognized arbitration provider (such as the American Arbitration Association), rather than in court, except that either party may bring an individual claim in small claims court if it qualifies. YOU AND HOUSE OF BAM EACH WAIVE THE RIGHT TO A JURY TRIAL. YOU HEREBY WAIVE THE RIGHT PARTICIPATE IN A CLASS ACTION. Arbitration will take place in DeKalb County, Georgia, or another mutually agreed location, and this arbitration provision should be reviewed by a Georgia-licensed attorney before the Site goes live to confirm the specific arbitration rules, opt-out procedure, and consumer-protection requirements applicable to House of Bam’s business.
17. Governing Law; Venue
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws principles. Subject to Section 16, the state and federal courts located in DeKalb County, Georgia will have exclusive jurisdiction over any dispute not subject to arbitration.
18. Modifications to These Terms
House of Bam may update these Terms from time to time. Material changes will be posted on the Site with an updated Effective Date, and, where required by law, communicated to Members directly. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
19. Notices
Any notice required or permitted under these Terms must be in writing and delivered by certified mail or courier to House of Bam at the address in Section 22, or by email to the address in Section 22. Notices to you may be delivered to the email or mailing address associated with your account or registration and are effective upon sending.
20. Termination
House of Bam may suspend or terminate your access to the Services at any time, with or without cause, including for violation of these Terms. Sections relating to intellectual property, liability waivers, indemnification, dispute resolution, and any other provision that by its nature should survive, will survive termination.
21. General Provisions
- Entire Agreement: These Terms, together with any Event-specific or membership-specific terms provided at signup, constitute the entire agreement between you and House of Bam regarding the Services.
- Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
- No Waiver: House of Bam’s failure to enforce any provision of these Terms is not a waiver of its right to do so later.
- Assignment: You may not assign these Terms without House of Bam’s prior written consent; House of Bam may assign these Terms in connection with a merger, acquisition, or sale of assets.
- Electronic Communications: You consent to receive notices, disclosures, agreements, and other communications from House of Bam electronically at the email address associated with your account or registration, and you agree that electronic communications satisfy any legal requirement that a communication be in writing.
- Force Majeure: House of Bam is not liable for any failure to perform due to causes beyond its reasonable control. House of Bam shall be not be considered in breach of or in default because of and will not be liable to the other Party for, any delay or failure to perform its obligations under this Agreement as a result of fire, earthquake, flood, explosion, strike, riot, war, pandemic, government mandated business closure or shelter in place orders, acts of foreign or domestic terrorism, civil disorder or disobedience, rolling blackouts, supply chain issues, strikes, or similar events beyond that Party’s reasonable control, curtailment of transportation facilities or any emergency beyond the Parties’ control, that would make it illegal or impossible to perform the obligations under this Agreement (each a “Force Majeure Event”). However, if a Force Majeure Event occurs, the affected Party shall, as soon as practicable:
- (a) Notify the other Party of the Force Majeure Event and its impact on performance under this Agreement; and
- (b) Use reasonable efforts to resolve any issues resulting from the Force Majeure Event and perform its obligations under this Agreement.
- Mutual Non-Disparagement. The Parties acknowledge that any disparaging comments by either Party about the other Party are likely to substantially depreciate the business or personal reputation of the Parties. The Parties agree to act in good faith so as not to harm the business or personal reputation of the other Party in any way. The Parties further agree not to directly or indirectly defame, disparage, or publicly criticize the services, business, integrity, veracity or reputation of the other Party, its owners, officers, directors, or employees in any forum directly or through any medium of communication. The Parties agree not to, without limitation, directly or indirectly, through executive officers or directors, defame, disparage, or publicly criticize the integrity, veracity or reputation of the other Party.
